1. Introduction

Welcome to Nightforge Studios LLC ("Nightforge Studios", "Nightforge", "we", "us", or "our"), a Colorado-based indie game and software development studio. We take your privacy as seriously as we take our boss battles, very seriously. This Privacy Policy ("Policy") describes how we collect, use, disclose, and safeguard your information when you visit nightforge.org, play our games, or interact with our services. By accessing or using our services, you agree to the terms of this Policy. If you do not agree, please put down the controller and discontinue use of our services.

2. Information We Collect

  • Information You Provide Directly: This includes information you submit when you contact us, sign up for newsletters, participate in forums, enter contests, or otherwise interact with our games and services. Examples: your name, email address, and any witty comments you send our way.
  • Transaction Information: When you purchase our games or in-game content, transactions are processed via third-party platforms such as Steam. We do not directly collect or store your payment information, but we may receive confirmation of your purchase (e.g., transaction ID, purchase date) for support and refund purposes. For Steam's privacy policy, see here.
  • Automatically Collected Information: Like most websites, we use cookies, pixels, and similar technologies to collect information about your device, browser, IP address, and how you interact with our site and games. This helps us improve your experience and keep the monsters at bay.
  • Usage Data: We may collect data about how you use our games and services, such as gameplay statistics, crash reports, and bug logs. This helps us squash bugs and balance the game (no, we won't nerf your favorite card, probably).

3. How We Use Your Information

We use your information to:

  • Provide, operate, maintain, and improve our games, website, and services
  • Process transactions and verify purchases
  • Respond to your comments, questions, and customer service requests (we love hearing from you!)
  • Send you technical notices, updates, security alerts, and support messages
  • Communicate with you about products, services, offers, events, and patch notes (no spam, we promise)
  • Monitor and analyze usage and trends to improve your experience and our products
  • Detect, investigate, and prevent fraudulent transactions, abuse, and other illegal activities (no cheating!)
  • Comply with legal obligations and enforce our Terms of Service

4. Cookies and Tracking Technologies

We use cookies and similar technologies (pixels, beacons, etc.) to enhance your experience, remember your preferences, and analyze site traffic. Cookies are small data files stored on your device. You can control cookies through your browser settings, but disabling them may affect your experience (and possibly your high score).

We may also use third-party analytics services (like Google Analytics) to help us understand how you use our site and games. These third parties may set their own cookies and have their own privacy policies.

5. Information Sharing and Disclosure

We do not sell, rent, or trade your personal information to third parties for their marketing purposes. However, we may share your information in the following circumstances (cue dramatic music):

  • With Service Providers: We may share information with trusted third-party vendors who help us operate our website, process payments (e.g., Steam), analyze data, or provide customer support. They are contractually obligated to keep your info safe and not use it for their own nefarious purposes.
  • Legal Requirements: We may disclose your information if required by law, subpoena, or court order, or if we believe such action is necessary to comply with the law, protect our rights, or prevent fraud or imminent harm (we hope it never comes to this).
  • Business Transfers: If we merge, sell, or transfer part or all of our assets (e.g., if Nightforge is acquired by a benevolent dragon), your information may be transferred as part of that deal. We'll notify you if this happens.
  • With Your Consent: We may share your information for other purposes if you give us explicit permission (e.g., if you want your epic fan art featured on our site).

6. Data Security

We implement reasonable and appropriate security measures (technical, administrative, and physical) to protect your personal information from unauthorized access, alteration, disclosure, or destruction. However, no method of transmission over the Internet or electronic storage is 100% secure, so we cannot guarantee absolute security. If you suspect a security issue, please contact us immediately.

7. Your Rights and Choices

  • Access & Correction: You may request access to or correction of your personal information by contacting us. We'll do our best to respond promptly (unless we're in the middle of a boss fight).
  • Opt-Out: You can unsubscribe from our marketing emails at any time by clicking the "unsubscribe" link or contacting us directly. We'll be sad to see you go, but we respect your choice.
  • Cookies: You can control or delete cookies via your browser settings. For more info, see your browser's help documentation.
  • California/Colorado/Other Jurisdictions: Depending on your location, you may have additional rights under local privacy laws (e.g., CCPA, CPA, GDPR). Contact us for details or to exercise your rights.

8. Children's Privacy

Our games and services are not intended for children under 13 (or the minimum age in your jurisdiction). We do not knowingly collect personal information from children. If you believe a child has provided us with personal information, please contact us and we'll delete it faster than a speedrun glitch.

9. Third-Party Services & Links

Our website and games may contain links to third-party sites and services (like Steam, Discord, or social media). We are not responsible for the privacy practices or content of those third parties. Please review their privacy policies before sharing your info. For Steam's privacy policy, visit https://store.steampowered.com/privacy_agreement/.

10. Refunds & Return Policy

We offer a return policy for our games and software purchased through authorized channels (e.g., Steam). To be eligible for a refund, you must provide proof of purchase (such as a receipt or transaction confirmation) and proof of the purchase date. Refunds are subject to the policies of the platform through which you purchased (e.g., Steam's refund policy may apply). We reserve the right to deny refund requests that do not meet these criteria or appear fraudulent. For Steam purchases, see their refund policy here.

11. Changes to This Policy

We may update this Privacy Policy from time to time (patch notes for your privacy!). We'll post the updated version on this page and update the "Last updated" date above. If we make material changes, we'll try to notify you (but you should check back here occasionally, just in case).

13. The Final Boss (Limitation of Liability)

By using our services, you acknowledge that while we do our best to protect your data, no system is invincible (not even ours). Nightforge Studios LLC is not liable for any indirect, incidental, or consequential damages arising from your use of our games, website, or services, except as required by law. If you have a dispute with us, please contact us first. We prefer to resolve things peacefully, not with a PvP duel. For more information, see our Terms of Service.
